Chandigarh stalking case: Accused Vikas Barala granted bail

The Punjab and Haryana High Court Thursday granted bail to Vikas Barala in the case of stalking and attempted abduction of Varnika Kundu.

Barala, a student of law, has been confined in Chandigarh's Burail jail since August 9, 2017.

"No application was filed on behalf of the prosecution alleging that the accused had made any attempt to influence anybody", said Vinod Ghai, the counsel for Vikas. It was also argued that the accused belonged to a well-connected political family and it was possible that he may use his clout to influence the trial of the case, if released on bail.

In December, Barala's counsel, seeking regular bail from the court, submitted his client had been behind bars for almost four months.

But then just days later, the Chandigarh Police restored the charges relating to kidnapping and arrested both Vikas and Ashish.

Barala, the son of the Haryana BJP chief, and his friend Ashish Kumar were arrested on the intervening night of August 4 and 5 following a complaint by the woman.

The latest development comes a day after Varnika's cross-examination had concluded in the district courts in Chandigarh. On December 7, the High Court had granted bail to him to appear in an examination on December 18 under police custody. Subhash Barala promised co-operation of his son in the police probe and several pleas were made but a trial court rejected their plea for bail four times until he was finally given bail.

The woman had accused Vikas Barala (23) and his friend Kumar (27) of stalking and attempting to abduct her.

The two men were arrested on the intervening night of August 4-5 past year following the complaint, but were released on bail as they were booked under bailable sections of the Indian Penal Code and the Motor Vehicles Act.
